Last week, the US House of Representatives advanced the MATCH Act — the Mandating Assessments of Chinese-procured Hardware Act. In plain English: Congress wants to lock chip equipment exports to China into law.

This isn't another round of sanctions escalation.

The rules of the game are changing.

What Changed

For the past three years, US chip restrictions relied on BIS administrative orders. The Commerce Secretary says "this can't be exported," and companies comply. That's an administrative action. A new Secretary could loosen it. A new administration could reverse it.

The MATCH Act shifts this power from the Commerce Department to Congress.

Translation: regardless of who sits in the White House in 2028, chip restrictions on China become codified law.

Tom's Hardware detailed the expanded scope: not just AI chips, but DUV lithography equipment (ASML's mainstream deep ultraviolet machines) now falls under the control list. The R Street Institute called it "Industrial Policy Dressed as National Security."

Why It Matters

If you're a decision-maker in a globalizing company, your strategy for the past three years was probably: "Wait it out. Eventually you'll be able to buy again."

With the MATCH Act, that assumption no longer holds. Because: executive orders can be changed. Laws cannot.

BIS export controls have explicit "controlled item lists" — companies can build compliance programs around them. But once Congress codifies the restrictions, the list only grows. Look at the CHIPS Act — passed in 2022, and already amended twice with additional restrictions by 2025.

Three Baselines to Reset

1. Supply chain planning: For chips, lithography equipment, and EDA software, assume restrictions will tighten over 5-10 years, not loosen. When building overseas factories, don't just look at labor costs — look at equipment procurement pathways.

2. Compliance budget: Spending $500K on an export compliance team used to be "big company" behavior. It's becoming a standard operating cost. Micron is already lobbying Congress to tighten further — big companies will use controls to cement their moats.

3. Technology roadmap: If the latest equipment is permanently off the table, can your product design "step back" to mature process nodes? This is what Huawei proved with the Mate 60 Pro — 7nm for a flagship chip isn't optimal, but it works.

Bottom Line

The MATCH Act is still in the legislative pipeline. But both R Street's critique and Lawfare's deep analysis converge on the same judgment: bipartisan containment of China's semiconductor sector is now Washington consensus.

Not whether — just how fast.
